More Samsung smartphones and tablets could be affected by the US import ban currently in place.
Apple has filed an appeal to broaden the US import ban to cover additional Samsung products. The Cupertino company has asked the US International Trade Commission (ITC) to review three more patent cases, following the ITC finding Samsung guilty of two patent infringements already.
Published by the ITC last week, Apple’s Notice of Appeal and Petition is asking the ITC to focus on patents relating to current Samsung devices, by modifying the claims on patents already asserted.
Currently, the US import ban relates to older Samsung models and doesn’t impact sales and shipments of new devices like the Samsung Galaxy S4 and Samsung Galaxy Note 3. If Apple’s petition is granted, Samsung could face newer models like the aforementioned being affected by the ban.
However, the ITC is currently on hiatus due to the US government shutdown so it could be a while before Apple’s petition is reviewed.
Samsung is also expected to launch its own appeal against the US import ban on selected Samsung products, following the Obama administration’s failure to veto it earlier this month.
“After carefully weighing policy considerations, including the impact on consumers and competition, advice from agencies, and information from interested parties, I have decided to allow [the import ban to proceed],” said Michael Froman, US Trade Representative and President Obama designee.
The US import ban on models including the Galaxy Tab, Galaxy Tab 10.1 and Galaxy S 4G was secured by Apple as part of a legal battle between it and Samsung over two specific patent infringements.
Samsung was found guilty of two patent infringements relating to a multitouch feature and a sensor for headphone jacks.
